There is a automobile workshop and saw mill noise pollution in adjacent and vicinity of our house. I and family members get headache, ear pain, heart pain, study, work disturbance, irritation.... with high decibel noise. Oh God, please help us.
I have filed public noise nuisance case with Honourable Sub-divisional Magistrate Court, Shirdi under section 133 of CrPC - Conditional order for removal of nuisance. In conditional and inquiry order my appeal was partly accepted. In inquiry ~77 db leq noise was recorded in residential zone. Few of noise polluting business were removed and others challenged the first order in Honourable District and Sessions Court, Kopargaon but in vain. I am myself pleader in the case and awaiting final judgement from Honourable Sub-divisional Magistrate Court Shirdi.
The petitioners among then respondents no. 1 to 10, have illegal industrial trade or occupation, that produces unbearable noise due to wood cutting, sharpening of saw by electric grinder by sawmill, repair automobiles, truck body building, dismantling & assembling workshop, lathe’s metal turning, electric welding, drilling, cutting & grinding, gas welding, cutting, hammering of metal, denting, bending, steel sheets with hammers, cylinder head grinding, full engine acceleration, horns and other unbearable noise & air pollution activities in residential area, illegal semi enclosed building, open grounds, encroachment on public way. Daily atleast 10-15 heavy vehicles like truck, JCB, excavator, dumper are repaired using above operations generating severe noise. To adjacent and in vicinity to then petitioners and like operations are carried on from dawn to dusk to late into nights to holidays and such then respondents industrial activities are at the root of all trouble, nuisance, is causing injury to the life, over all health, physical comfort and livelihood of then petitioners, patients, employees, family, children, friends, passerby, relatives, public by way of headache, ear pain, deafness, blood pressure, study, sleep, irritation and each such nuisance comes within the category of an public nuisance and that in consequence such industrial trade or occupation should be prohibited or removed from residential zone. For such a public nuisance under CrPC section 133(1)(a) & (b) on behave of community one complaint is enough.
